What would my "Creations" be classified as ?

Ward-Ron wrote on 12/18/2022, 9:53 AM

I'm trying to upload stuff I made in Music Maker to Spotify (Yes, I triple checked the licenses and such) and it's asking me to select if my music is:
1) Original (You recorded everything)
2) Remix (You took an existing track and mixed it)
3) Cover (You basically sung a song that already exists)

The problem is, I don't know which one of these applies to: "I used loops from Music Maker (and only Music Maker) to create an entirely different song, and didn't record anything myself". Could someone help me with this label please, as it's a required field and I don't want to put the wrong info down. Thank you

@Ward-Ron I think you usually need to select Original, because Remixes and Covers are handled differently in terms of royalties.

Hi

The Spotify classifications are defined by the standard definitions of Licensing and Copyright, in your particular case none of the Spotify options are truly appropriate.

As @SP. has commented use 'original work' is the closest.

The technical definition of 'original work' means that you have composed, and created the music by playing and recording the various instruments for the music product..

In the case of Music Maker you can only truly achieve this definition is by using the VST instruments only.recording yourself playing them or writing the MIDI notes in the MIDI Editor.

The licensing of Soundpool loops does allow them to be used according to the licences purchased, however their use gives rise to another issue:-

Copyright infringement claims from other users, and 3rd party entities who 'copyright' music on behalf of the users who have used those entities services.

This has been discussed many times in the forum with other users who have been hit with claims - none of which are justified under the Terms and Conditions of the Soundpool licences.

Trying to fight these claims, particularly against these 3rd party entities is difficult, despite the licencing being very clear that copyright is retained by Magix, and a user does not have, nor can claim, exclusive rights to the use of the Soundpool loops.

So in otherwords, I need to make sure I have the right license (I do) and select "Original" as it's not a Remix of the Demo Track, as well as prepare for the possibility that I could end up with Copyright claims, despite all this (even if the mixes I've made aren't like anything else out there currently).

Is this correct @johnebaker ?
