Commercial Use And License

Okay, so I have a bit of a trick question...

I do not sell my music, I give it away; in which people can download it for free off bandcamp. Recently, I have made a new album, with some commercial license use of musicshake (which I have purchased), as well as here with Magix Music Maker 2015. I used some of the soundloops. Now, even though I do not sell the music composed, I did start up an indiegogo campaign to help me produce manufacturing of a 50 CD press of that album (of which I pitched in $500 and some friends added $175).

Does this form of manufacturing, even though technically donations merely to help press the album, fall under the guidelines of "commercial use"? The prices were all for the manufacturing alone, and I have not made profit off the albums...infact I lost cash doing it myself (highering mixers, mastering, etc). Not to mention no albums have sold for a price off bandcamp, they are all free.

I am curious if I still need a commercial license to use the soundloops in this incident. I would not want to feel as if I am cheaping out the actual composers of the music (BTW only my lyrics have a copyright on the page and credit is given to MMM as well as musicshake). Any info on this would be great.

Thank you,

Michael

I should probably also add in, that technically speaking, for free downloads on bandcamp, it is not considered "unlimited" crowd. Members only have a limit of giving away 200 free downloads per month. And that's not per album (or per track), that's 200 total. And I have 24 albums up. So, that's roughly less than 9 downloads per album a month, if shared equally. So again, do these actions fall in the lines of "commercial use"? Thanks again.

Hi

For information - the 'paraphrased' response from Magix is:

Because the works are in a non private environment. The "Audio Pro Unlimited" license for the Soundpools or Sound Packs that have been used are required for the production.

Thanks.

But does not this go against the quote on: http://magazine.magix.com/en/commercial-use-of-music/

Which states...Can I publish the songs I’ve made with Music Maker loops and sounds online?

"The rule is as follows: As long as your own songs – which contain loops or sounds from Music Maker/ Music Maker Jam – are not used commercially, you can upload them to Soundcloud, Youtube or other portals."

I have them on Soundcloud, no Youtube. I also have them on Bandcamp. Is there a difference between Yourtube and Bandcamp I am unaware of? Is not Youtube also considered a non private environment? I make no money off the music. I post them up as one would on Youtube or Soundcloud. I am having trouble understanding the difference in what they posted on the site, to what they say I need to buy.
