Are the soundpools from  Music Maker 2017  copyrigthed?

If I buy MM 2017 are the soundpools copyrighted and this link http://magazine.magix.com/en/commercial-use-of-music/ applies to them. Or in this  version the soundpools can be used for commercial piurpuses?

What about the premium version (MAGIX Music Maker 2017 Premium)?

all soundpools are copyrighted, you must have the audio unlimit lizenz

Thank you guys, for your answers! However I don't agree with what John wrote in the links:

because in this article from Magix http://magazine.magix.com/en/commercial-use-of-music/ they are stating something different:

"Can I publish the songs I’ve made with Music Maker loops and sounds online?

The rule is as follows: As long as your own songs – which contain loops or sounds from Music Maker/ Music Maker Jam – are not used commercially, you can upload them to Soundcloud, Youtube or other portals.

Just so there are no misunderstandings: MAGIX does not own the rights to your compositions. You own the copyright to these. Only the sounds and loops that you have used are protected by copyright."

 

I agree with Janvo that the loops cannot be used for commercial purpuses but I don't agree with John that I can't upload my tracks on soundcloud or youtube. If I understood it corectly I can ulpoaded my tracks to soundcloud or youtube without any license. Am I right?

The information I posted was received from Magix in Sept 2016, the article you linked to is from Sept 2015.

From my personal experience of copyright, IMHO, Soundcloud etc could be classed as 'commercial sites'.

There is an increasing trend in advertising appearing on sharing sites alongside the videos and music or as a 'trailer before the main event' .  In many cases this advertising cannot be avoided and as the companies themselves are making revenue from the placed advertisements then you are in a 'commercial environment'.

In addition there is still the issue of copyright claims to be taken into account from the second topic I linked to below:

There is a downside to using the Soundpool loops, rather than creating your own rhythms etc using the synthesizers, in that you will get hit by claims of breach of copyright from other users of Music Maker.

However such claims are often not legal because the claimant, and yourself, never own the copyright to the soundpools, this belongs to Magix or the Soundpool creators.

The claimant, like yourself. only have a licence to use the Soundpools commercially - assuming they have bought the correct licence and similarities will exist.

I will ask for further clarification on this matter.
