Who is violating copyright?

The youtube notified me that there is a problem with copyright in this video ( from minute 20:43 to 21:13. Youtube says, the music and the author are: "Golgotha - Osvaldo Camahue". I'm not a musician and not even know this song "Golgotha". I built the music (sounds) entirely with the Music Maker.

Is the song "Golgotha" violating copyright? This music seems to me to have been built with the Music Maker (because many sounds are equal)? Or is it the Magix/Music Maker that violate copyright?

I know that there are coincidences! I will be now a real musician !? I did a song with the music maker and youtube detected copyright issues! It's fantastic! It seems to me that the problem is not a specific loop, the problem is the composition which coincided with an existing one. I had bad luck!

In the future there will be a big problem .. if someone records a song that is similar to ours, automatically our music is violating copyright. No one should have the copyright of a song that already exists (with or without copyright).

The video I mentioned will be removed (it's temporary) ... I'll probably change the music, because it's easy with the music maker ...

I consulted, right now, the file source of my music and copyright issues only refer to the loop "Special FX C1.ogg" (Movie Score Vol.) ... I want to challenge for the non-approval by Youtube ... But for that I need to know if the Magix ensure that the file «Special FX C1.ogg" has no copyright problems.

- They did not accept the complaint. It is also possible complain again but is more complicated.
- I removed the video, above.
- I changed the music and I upload another video. Was another problem copyrighted detected, in another timeline zone, that previously had no problems. Now, the copyright issue is related to another sound file / Soundpool "Trombone stacc b 1.OGG". This loop can be heard at 2:00 in the video "Terribilis Montes by GANOM ':   (not mine). The problem is not all the music / composition. The problem is a particular Soundpool / loop. I did not invent the soundpools. Someone is making music with the MUSIC MAKER and register the song with copyright. I think that he can not....  I do not know!
- It seems that I have not conditions to obtain a content ID.

The tune Golgotha is on SoundCloud and starting at 1:15 to 1:45 does sound identical to the section of your video sound track claimed as breaching copyright.

This is a common problem.

The argument to put forward to Youtube is that you have used Magix Music Maker's standard soundpools listing which ones you have used - I presume Movie Score 4 is one of them - and any similarity is coincidental.

Yes this is a very common problem on YouTube when we use Royalty free/Rights free music or as in this case using Magix soundpool. It is possible the soundpool you used any other Magix user or I can use and when we both upload video on YouTube with the similar music can get content ID claim/copyright claim.

Question is what you can do? According to YouTube when we use Royalty free/Rights free music and got proof of permission to use that from where we bought that. We can give the url link where license terms are mentioned or in case you got in an e-mail copy/paste that when dispute the case with YouTube.

Finally, any Magix audio we use in composition is copyrighted by Magix even if we buy pro license that particular audio is given to us to be used under license terms set forth and the copyrights of that particular audio will be retained by Magix.

I did not mention "Magix license terms". I only mentioned that I had created the sound with Magix Music Maker. In a second attempt (I create three films, from the first, to concatenate on youtube) i changed the sound, in part with copyright issues. But risen a copyright problem in another part of the sound. I will again remove the sound concerned. I'll try again. The big problem: It takes many hours to generate a new video file in my computer. If new conflicts arise, I will mention the terms of Magix, if possible.
