Need Clarification:MusicMaker Free,Live Sets may be used commercially?

I purchased Boxed copies of Vegas Movie studio Platinum 16 suite and Magix Music Maker plus.

I have acquired:
Magix Music maker including all contents and features
Magix Music Maker-Feel Good Sound Pool
Score-Modern Fairy tales Sound Pool with commercial license
Music Maker Live Pads and Live Sets that contains 30 Live sets for commercial use

I consider these as music loop resources to make personally created content for commercial use such as monetized YouTube videos.

According to END USER LICENSE AGREEMENT accessed by clicking the link in the About Magix Music Maker.
Sections 1.1, 1.2, 1.3, 1.4, 3.2, and 3.3.

and

According to License agreement for MAGIX Products by clicking the link https://www.magix.com/int/eula/consumer/.
Sections 1.1, 1.7, and 5.2.

I understand that I can use these music loop resources to produce Personally created content and I can use it commercially.

 

My first question to anyone in this community.

Did I understand it correctly that I may use the music loop resources to produce personally created content for commercial use such as monetized YouTube videos? (Yes/No) Thanks in advance for your answer.

 

My second question.

Is there any body in this community who happens to be a lawyer that found making music using Magix Music Maker as a fun recreational hobby and could you please answer my first question for free?

@AlvinCalendacion You need the commercial licenses for each Soundpool you want to use commercially. Then you can use it for monetized videos on YouTube. Or you can release your music on streaming services.

But you cannot resell your music to other content creators for them to use in their projects. They also need to buy a commercial license for each Soundpool used.

But even if you have a commercial license you can get copyright claims on YouTube because somebody else used the same loops. In this case you need to inform YouTube about your commercial license and that you have the right to use the loops in your video. The claim should be removed after this.

Be aware that YouTube usually does not allow to monetize loop based music because of these problems.

The best for me to do is always opt to purchasing commercial license directly from the in-App store or from producerplanet.

I could never know when one of my works could become viral and eventually become eligible for monetization.

My initial query can be summarized in two things
1. Commercial use of included sound pool and additional purchased soundpool.
2. Commercial use of the contents from Live Pads and live sets feature.

No problem. You're welcome. Glad to hear I could help. Sure, you're welcome to re-post the information. I think, generally speaking, the experienced users in the community should be fairly well informed when it comes to the licensing terms for regular soundpools and the need to purchase commercial add-on licenses etc.

However, the specific aspect of Live Sets being cleared for commercial use is possibly something that not everybody is aware of.

Thank you for your message. Here's what you need to know about commercial use of our content:

Live Sets: All the content that comes with the Live Pads (i.e. the "Live Sets") is already cleared for commercial use. It does not require the purchase of any commercial add-on license.

Soundpools: It sounds like you may have some misconceptions as to the (included) soundpools. Starting in version 17 of the MAGIX Soundpool DVD collections and audio content bundled with the Music Maker product line, the use of the provided audio content is limited to private and non-commcerical use. The same applies to soundpools purchased through the in-app store via edition credits starting in generation 2017 of Music Maker. The public presentation of the songs is still possible as long as it's non-commercial (e.g. YouTube without using any monetisation on your channel). However, for commercial productions you will need to obtain a suitable license for the content in question via Producer Planet (www.producerplanet.com). You can use the browsing and search functions here to locate the licenses for the specific soundpool style(s) and volume(s) that you have used from the styles included with your Music Maker version or on your Soundpool DVD collection, and clear them for commercial use.

A more recent addition is the possibility to already opt for the commercial version of the soundpool license in the in-app store system of Music Maker when you first purchase the soundpool. If you already know ahead of time that your use of the content is going to be of commercial nature, you probably always want to go with the commercial option in the first place.

Please note that these restrictions and licensing requirements only apply to using the soundpool/loop content provided with our program. If you use Music Maker purely as a DAW to compose/record your own original material, there are no such limitations and no need for additional licensing. This includes the use of the provided VST/software instruments (when used to play back your own compositions).
