Hi mb2222

This is not a direct answer to your question but a pointer to potential pitfalls regarding licensing and copyright

Yes John thanks, I know one needs the audio pro license from catooh.com. Has anyone done it and sold a song?

Sorry mb2222,  Jon has a Knack for pointing out the obvious.

I  believe that no one has bothered to try and make $ off our songs. We are not pros. Most of us are using programs like magix  just for kicks. For ourselves really. If you need proof , listen to some of the self-indulgent tunes here.

I think magix would be upset if you made $ with out giving them some, obviously. However if one looks at the case of John( jon, I dunno) Fogerty, the court ruled, one could patten lyrics. No mention of sound really. Magix did provide the sofware  however and that is where they will gett you if you try to make a move without their permission. Can't make a symphony and then not give credit to the band. Even if the band is in MB.

Not cool in their eyes.

The reason  of why we make music and post it here however, is simple. Diversity. No where can u go on the net and find ,not only people like yourself using a program you know, but to hear how truly diverse and incredible our imaginations are while using a music program. This proves, to us at least, even wih out the proper equipment, studio's or $....your song can be still sung.

Hi

As Kourse says I have the knack of pointing out the obvious   - unfortunately it is very necessary on occassions when posters do not provide sufficient information on the problem and what they have already tried and researched.

Agree with Kourse's comment about not giving the credit to the band and a little monetary return for using them.

I use MMM specifically for creating soundtracks for my movies created in MEP,  and have no intention of making money from it.

Cheers

John

Well I do intend to sell music made with magix.  Personally I think they could be more clear with the rules, so one must assume they are being INTENTIONALLY VAGUE (are you reading this Magix?) so that they can pounce on someone with their lawyers if they see someone making a substantial amount of money from their loops. Now, go to Catooh and read their policy. ALSO not clear http://www.catooh.com/index.php?resize=0&popid=58&mediaId=243967

2. Granting of rights

The provider grants the customer unlimited temporal and physical, non-exclusive and non-transferable rights to private and non-commercial usage of the content. With this consideration the provider grants the customer unlimited temporal and physical, non-exclusive and non-transferable rights to the following commercial usage of the content:

a. Use in edited form or in the context of another work

(1) The customer receives the common and non-transferable right to edit and/or join the content with other pieces of work, and use the content or let it be used in the context of this editing or joining with another work:

(a) The customer is allowed to copy and distribute the edited or embedded content. The right to granting of time-limited permission to use (rental or lease) is excluded.

(b) The customer has the right to present the edited or embedded content or make it publicly perceivable using image or audio carriers.

(c) The customer has the right to keep the edited or embedded content publicly in a state of readiness.

(d) The customer is further allowed to broadcast the edited or embedded content, or to let it be broadcast.

(2) Definitions:

(a) An editing of the content is necessary only if the customer’s personal creativity is exhausted. Immaterial changes are not considered editing in the sense of this contract, and may only be applied according to the regulations utilized in paragraph 2. b.

(b) A connection to another work in terms of this contract exists if the content is connected to a different piece of work protected by copyright (for example, spoken or film piece), i.e., in the case of the object with which the content is connected representing an independent work in terms of the respective copyright specifications. A connection to commonplace objects does not represent a connection to another work according to the terms of this contract. The conditions outline in paragraph 3. (1) are to be respected.

Lots to ponder there. So I wrote them and asked very clearly, and they gave a clear response.

Subject:
Sound pools

Message:
If I get a soundpool with audio pro unlimited license, and string
together some loops from the soundpool using Musicmaker MX, can I sell
the song online for profit?

Dear xxxxxxxx,

Thank you for your message.

Yes if you purchase the Pro Audio licence, then you can create songs and sell them commercially.

SO, where are we at now????

Kourse wrote on 4/30/2012, 1:03 PM

Who are you selling to? Out of the litterally thousands of recording/production companies that already exist in the world, who would be intrested in anything we do here? Who is looking for music made and produced by the average joe? I would LOVE to know that . As would I'd say...oh i dunno , 140,000 other people....

mb2222 wrote on 4/30/2012, 8:21 PM

Wow don't underestimate yourself or these tools. As for how to sell it, check out cdbaby, reverbnation, tunecore, catapult, bandcamp, or others. They can have your songs up on iTunes in 24 hours, also amazon and googleplay. Of course even if we can equal the quality of most songs you hear on the radio these days, you cannot equal the marketing. That's where you need to first get online, and second find creative ways to get listeners. If that's not what you're into thats cool, but look on cdbaby, lots of great music by "regular joes".
